2. PRODUCTS AVAILABILY & PRICING

We try to keep all product availability up to date. If you have requested a product that is on back order or not available, please email or call us and we can tell you when the item will be back in stock or that is has been discontinued. Sometimes with the volume of orders we receive, an item can go out of stock before we're able to post notification to the site. Wherever possible, we will notify you personally so we can help you find another item.

Sometimes, data may be inaccurately displayed on our site due to system errors. Whilst we make every attempt to avoid these errors, they may occur. We reserve the right to correct any and all errors when they do occur and we do not honour inaccurate or erroneous prices. Our prices are also subject to change without notice. 3. ORDERING AND ACCEPTANCE OF YOUR ORDER

You place your order request for goods from the Website by clicking on the confirm order button at the end of the on-line order process. You will be guided through the process of placing an order by a series of simple instructions on the Website.

Once you have placed your order, we will send to you an acknowledgement providing you with a payment reference and the value of your order that has been debited to your credit/debit card. This is not an order confirmation or order acceptance from Pinkbox Company.

Unless we have notified you that we do not accept your order or you have cancelled your order in accordance with the Cancellation and Returns Procedures set out below, our acceptance of your order and the completion of the contract between you and us will take place when you receive an email from us notifying you that we have dispatched the goods ordered by you.

Our acceptance of your order will be deemed complete and received by you at the time and date of sending of the email, which time and date is specified on the email. The deemed time and date of receipt by you shall apply regardless of whether, for reasons outside our control, you have not received that email. Following dispatch, which may form part of the dispatch confirmation email, you will be sent by email a VAT, Sales Tax or other invoice, as may be appropriate from time to time. We may not accept your order if an item you have ordered is out of stock, we are unable to obtain authorisation for your payment, or if we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time.

If we are unable to fulfil your order following our order acknowledgement, we will contact you by email or telephone advising you of this. See Cancellation and Returns procedure set out below.

4. PRODUCT DESCRIPTION

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including product descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted in accordance with our order acceptance policy.

We make every effort to ensure that our product catalogue is as accurate and complete as possible. In order to give you the opportunity to view our products in greatest possible detail, some products, in our photographs, may appear larger or smaller than their actual size; and since every computer monitor is set differently, colour and size may vary slightly.

Our objective is to provide you with as much information and detail about your prospective purchase as possible so that you can see the attractiveness, colour and shape of any product.

In regard to jewellery and in compliance with generally accepted US industry standards and FTC regulations, you should be aware that carat total weight in all products may vary 0.05 carats from stated weight.

On our website, we display the dimensions of our products based on the technical information we have received from our manufacturers. For jewellery items, the stone sizes stated in the product description are provided by the manufacturer. We understand that these are taken prior to the addition of the metal in the manufacturing process, which may lead to a discrepancy in any measurements taken after this process. Also, for each jewellery item containing multiple diamonds, we list the average grade and measurement for colour, clarity, and carat weight, or other as may be appropriate, as provided to us by our suppliers.

5. PAYMENT PROCESS & TAXES

All prices indicated for products available via the Website are inclusive of VAT (where applicable) at the current rates and exclude delivery charges, unless otherwise notified. The total cost of your order is the price of the products ordered plus VAT (or Sales Tax where appropriate) and delivery charges as set out in the Delivery section of the Website. Payment can be made by any of the methods specified in the Payment section of this Website and payment will be debited and cleared from your account as set out in the Payment section of this Website. Depending on stocking levels, your order may be shipped from any of our distribution centres, primarily in Africa, UK and USA, so as to get product to you as quickly as you require.

If your order is being despatched from our UK warehouse facility, to any destination in the European Community (EC) including the UK, then your order will include VAT at the current rate (17.5%). If your order is being despatched outside of the EC including the USA, then your Sales Tax will be zero. If you are a USA based customer and your order is despatched from a US distribution point, you will be notified of any Sales Tax (if appropriate) at the time of purchase. Any international orders despatched from the US, will be zero-rated for Sales Tax and VAT. Any customs or import duties levied for any international shipments, once your product package reaches your destination country, will be your responsibility. We have no control over these changes and cannot predict them and they may vary from time to time, country to country.

You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or subsequently refuses to, or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

6. PASSING OF PROPERTY

We will retain the legal ownership of the goods until full payment has been made by you and such payment has been received by us. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.

7. RISK

Risk in the goods will pass to you on delivery to you.

8. DELIVERY

We will deliver the goods in accordance with the delivery option selected by you during the order process. Please check to see our current delivery options as these may vary from time to time.

Any delivery timescales quoted to you are indicative only. Orders may be delivered in one or more delivery.

Pinkbox Company  does not accept any liability whatsoever for delayed delivery caused by any third party. As soon as you have received the goods, you will assume all risk in the goods. Upon delivery of the goods to you, we will also provide you with sufficient details to enable you to: a) exercise your right of cancellation; and b) address any intended cancellation or complaints to the correct place of business.

9. ACCEPTANCE OF GOODS

Upon receipt of the goods you must inspect the goods and you will be deemed to have accepted the goods unless you notify us that you have cancelled the order and/or you return the goods in accordance with the current Returns Procedures as available on our website. If no such action is taken, we shall not be obliged to accept any rejection of the goods at a later date. Your statutory rights are not affected.

Any breakages must be reported to us to the above contact details within 48 hours of receiving goods.

10. RETURNS PROCEDURES AND CANCELING AN ORDER

Please note that you may cancel this contract if you give us notice by telephone or by email at any time before the expiry of a period of 7 working days beginning with the day after the day of delivery of the goods. Any jewellery ordered can be returned unworn and you should keep and return all packaging materials as they were sent to you. In the UK, all products must be returned by Registered Post and in the EU, USA or Rest Of the World, all orders must be returned by either FedEx, UPS or DHL. All returns must be insured by you to the full value of your purchase. We do not in any way accept responsibility for the non-arrival of returned goods.

Should you wish to cancel your order before it has been dispatched, please click on the Returns Page and follow the procedure set out in the How to Cancel an Order page. 21. DISPUTES
